Statement 1 is correct: As per the fifth schedule-The Tribes Advisory Council is established in states with Scheduled Areas. It can also be set up in states with Scheduled Tribes but no Scheduled Areas, only if the President directs so.

Statement 2 is correct: As per the fifth schedule-The council consists of up to 20 members, with three-fourths being representatives of the Scheduled Tribes in the Legislative Assembly of the State. If the number of representatives of the Scheduled Tribes in the Legislative Assembly of the State is less than the number of seats in the Tribes Advisory Council to be filled by such representatives, the remaining seats shall be filled by other members of those tribes.

Statement 3 is not correct: As per the fifth schedule- The Governor can make rules regarding the number of council members, their appointment, and other procedural aspects. However, consultation with the Chief Minister is not mandated.
