The April 2023 amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, introduced by the Ministry of Electronics and Information Technology (MEITY), primarily aim to enhance the regulation of online gaming, particularly those involving real money. 1. Classification and Regulation
- Online Games and Online Gaming Intermediaries: These are defined as games accessible via the internet along with the platforms that facilitate access to these games.
- Permissible Games: Online games are categorized into permissible ones, which include both real money games and others, verified by self-regulatory bodies.
2. Self-Regulatory Structure
- Verification by Self-Regulatory Bodies: Only online real money games that have been verified by these bodies are permitted.
- Duties of Online Gaming Intermediaries (OGIs): These intermediaries are required to implement due diligence, monitor content, and ensure user protection measures are in place.
3. Content and Advertisement Restrictions
- Prohibited Content: Any content that involves gambling or poses harm to users is strictly banned.
- Advertising Restrictions: There are limitations on advertisements for non-permissible games and platforms offering such games.
4. Operational Requirements
- Policy Updates: OGIs must notify users about updates in platform policies within 24 hours.
- User Verification and Safety: Policies concerning user verification, transaction security, and methods to prevent user harm must be included.
- Immediate Compliance on Government Requests: Any information requested by the government relating to permissible online real money games must be provided within 24 hours.
5. Grievance Redressal and Compliance
- Grievance Mechanisms: OGIs must establish systems for receiving and tracking complaints.
- Verification Marks: A visible mark of verification for online games by a self-regulatory body must be prominently displayed.
6. Transition and Applicability
- Grace Period: The new rules will be enforced three months after at least three self-regulatory bodies are designated by MEITY, unless specified otherwise.
These amendments aim to foster a more regulated and safer environment for online gaming in India, enhancing protections for users and promoting responsible gaming practices.
