Dark patterns are deceptive design techniques employed on websites and applications that mislead consumers into making choices they may not have considered under transparent circumstances. Common examples include hidden fees, misleading navigation, and ambiguous wording that confuses users.
The Central Consumer Protection Authority (CCPA) initiated these guidelines in response to a surge in consumer complaints regarding misleading online practices. The primary aim is to establish fair digital commerce practices and safeguard consumers from being misled.
The guidelines specify 13 distinct types of dark patterns, such as drip pricing, disguised advertisements, bait and switch tactics, and the creation of false urgency. These practices are classified as unfair trade practices under the Consumer Protection Act, 2019.
E-commerce entities must comply with these guidelines to prevent manipulative practices detrimental to consumers. This entails ensuring transparent pricing, clearly distinguishing advertisements from content, and presenting terms and conditions in a straightforward and understandable manner.
Violations can result in actions taken under the Consumer Protection Act, 2019. This may include penalties imposed on e-commerce platforms and other parties that promote or utilize dark patterns to deceive consumers.
The "Guidelines for Prevention and Regulation of Dark Patterns, 2023" complement existing consumer protection measures, such as the Consumer Protection (E-commerce) Rules, 2020, and the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022. Collectively, these regulations create a comprehensive framework aimed at protecting consumers in the digital marketplace.
